We represent both buyers and sellers of real property in acquisition, financing and sales of commercial and multi-family properties. Services typically include negotiation and preparation of a purchase and sales agreement. After the agreement is prepared, we assist our buyer client in completing due diligence items such as title review and property inspections. Often a title report will include multiple exceptions such as restrictive covenants, easements and agreements which effect the use of the property. We review these with the client to insure that they will have no adverse effect on ownership. Where necessary surveys are obtained to properly locate the restrictions or easements.
We represent buyers who intend to develop or improve the acquired property. Services can include creation of organizational ownership documents; subdividing the property; preparing restrictive covenants, easements or shared use agreements; or subjecting the property to the condominium act to allow sale of smaller units. We try to help our clients achieve their goals in the most cost effective manner possible.
We have represented lenders and have an understanding of their needs in making loans to our borrower clients. We also use our experience to advise sellers where they will take back financing on their property including preparing appropriate lending documents such as notes, security deeds and guarantees. Where necessary we help our clients recover a property on a defaulted loan by real estate foreclosure. Our goal is to make sure that our client is paid when it sells a commercial property.
We review, draft and negotiate retail, office and industrial leases on behalf of both landlords and tenants. Because of our experience in dealing with both landlords and tenants, we have an understanding of what should be the primary concerns for both parties in the leasing process. Our time is spent reviewing and addressing those concerns without wasting time on needless issues.
